UGC Terms of Service

These additional terms for the use of your user-generated content (“UGC”) by Viscata (these “UGC Terms”) supplement and are in addition to Viscata’s Terms of Use (the “Standard Terms”). By responding with #ViscataStyle, you agree to these UGC Terms and the Standard Terms, including the arbitration provision in the Standard Terms. If you do not agree to these UGC Terms and the Standard Terms, do not use the hashtag #ViscataStyle.

To the extent there is a conflict between these UGC Terms and the Standard Terms, these UGC Terms will govern. Viscata reserves the right to modify or amend these UGC Terms at any time, in its sole discretion, without advance notice. Any changes will be posted on our website or communicated via email. Your continued use of #ViscataStyle after such changes constitutes your acceptance of the revised terms.

Definition of UGC

“UGC” refers to any video(s), photo(s), or other content you post online (e.g., on Instagram, Facebook, Twitter, or other platforms), along with your name, username, social media handle, profile picture, likeness, captions, location information, or any other details associated with the content.

License Grant

By using #ViscataStyle, you grant Viscata and its subsidiaries, affiliates, and partners (collectively, “Viscata” or “we”) a perpetual, worldwide, royalty-free, non-exclusive, transferable, fully paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your UGC in any media formats and channels now known or later developed. This includes, but is not limited to:

  • Viscata websites (e.g., viscata.com);
  • Social media platforms (e.g., Instagram, Facebook, Twitter);
  • Newsletters, email campaigns, and other digital media;
  • Retailer sites, third-party platforms, and print materials;
  • In-store displays, television, and other broadcast media;
  • Marketing, advertising, and promotional materials.

Viscata will not sell, lease, transfer, or assign your UGC to any third party without your prior written consent, except as expressly provided in these UGC Terms.

Your Rights and Termination

You retain ownership of your UGC. However, by using #ViscataStyle, you grant Viscata the rights outlined above. If you wish to terminate this agreement and revoke Viscata’s license to use your UGC, you may do so by contacting us at support@viscata.com. Upon receipt of your request, Viscata will make reasonable efforts to stop using your UGC within a reasonable timeframe, subject to any prior commitments or legal obligations.

Your Commitments

By using #ViscataStyle, you represent and warrant that:

  1. Ownership: You own all rights to the UGC, including any intellectual property rights, or you have obtained all necessary permissions to grant the rights outlined in these UGC Terms.
  2. Permissions: If your UGC features any person(s) other than yourself, you have obtained their consent to grant Viscata the rights to use their likeness, name, or other identifiable information.
  3. Age Requirement: You and any person(s) featured in the UGC are at least 18 years old. If any person(s) featured are minors, you have obtained consent from their parent or legal guardian.
  4. Accuracy: The UGC is a true and accurate representation of your honest opinion or experience with Viscata products.
  5. No Misrepresentation: The UGC does not misrepresent your affiliation with any person, entity, or brand.
  6. Compliance: The UGC does not violate any laws, infringe on any third-party rights, or contain defamatory, obscene, or otherwise inappropriate content.

Third-Party Platforms

By posting UGC on third-party platforms (e.g., Instagram, Facebook, Twitter), you acknowledge that such platforms may have their own terms of service and privacy policies governing the use of your content. Viscata is not responsible for the use of your UGC by these third-party platforms.
